Terms and Conditions
These Terms and Conditions do not affect your statutory rights.
The information
contained on this website is not usually intended to be used by anyone
less than 18 years of age and we are not prepared to contract with anyone
under that age.
These terms regulate the legal relationship between yourself and us. These Terms and Conditions shall not be altered, modified or varied unless expressly agreed in writing by both parties.
The information
on our website does not constitute a formal offer to sell Goods to you.
Your Order is an Offer to buy Goods from us. Automatic confirmation of
receipt of your Order does not constitute a Contract between us. A Contract
for the Sale of Goods shall only arise on the despatch of our written
confirmation of acceptance of your Order or the despatch of the Goods
to you, whichever is the earlier.
The prices quoted may be subject to revision by us in the event of any
increases imposed by the manufacturer before the date of despatch of Goods
to you. We also reserve the right to amend the price in any sale before
despatch arising where a pricing error has occurred either in favour of
ourselves or you. In these cases we will contact you to notify you of
the variation and you have the right either to proceed at the amended
price or to revoke the Contract.
The price of Goods includes all packaging, insurance and administrative charges but does not include delivery charges which are in addition to the price and will be charged on the basis calculated on the purchase screen according to the weight of items sold and their destination.
Payment
All
prices are in GB £ sterling. Payment is accepted by credit card.
We accept Visa, MasterCard, Switch, Delta, Solo and other debit cards
with the Visa logo (or sterling cheques drawn on a UK Bank). We are entitled
to present your cheque or credit card details to our Bank before despatching
Goods to you and may delay despatch of Goods until after funds have cleared
into the credit card or bank account.
Delivery
We
will try to arrange for delivery of all Orders within seven working days
within EU countries and within twenty-one days for the rest of the world.
However, due to the individual nature of many of our products there will
be times when a longer wait is involved. In this case, we will advise
you of the likely delivery date and if you are unwilling to accept the
delay, we will immediately cancel your cheque or card payment authority
or refund your money if payment has already been made.
Some
of our Products are specialist products which are manufactured utilising
traditional techniques that have been developed over many years. On occasion,
these manufacturing techniques may cause delays in production that are
beyond our control. This is particularly true of pewter and glass. We
therefore reserve the right to revise delivery dates in the event of circumstances
beyond our control. However, you, the customer will be notified immediately
of any delay to the anticipated delivery time and you will be given the
option to cancel the order. If you choose to cancel your order, a full
refund will be provided.
Returns
If
on receipt of Goods you are dissatisfied with their quality or the Goods
arrive damaged then you must advise us within 10 days in the form indicated
on our website. In the event of the Goods being damaged we may ask you
to return or retain the Goods until our Insurance Claim is settled. If
you return undamaged Goods in good condition, then upon receipt we will
refund the price of the Goods (but not the cost of returning them to us).
If the Goods are damaged we will return your payment plus the cost of
returning the Goods to us.
Guarantees
All of our products are guaranteed against faulty workmanship and defective
materials for 90 days
from date of purchase. Our products that are shipped directly to you are
insured against loss and damage.
Many of our products are hand finished and the glassware is hand blown, from recycled glass. As with all hand finished products it is expected that there will be some variance in finish and tolerances (we think that, that is part of the charm of these products!).
Our guarantee does not affect your rights under the UK/EU consumer protection act.
Pewter is generally not dishwasher safe and should be washed with regular dishwashing liquid in warm water. Some tarnishing will occur if pewter is machine washed. Please see the Pewter Care Instructions.
Taxes
and Duties
All
Goods are sold to you according to United Kingdom Value Added Tax (VAT)
law. This means that if you are registered within the EU (but outside
the UK) for VAT the Goods are sold to you free of VAT. If you are based
inside the UK or within the EU but not registered for VAT then the Goods
are sold to you with VAT charged. If you are based outside the EU, the
goods are sold to you free of VAT.
The payment of all other local Duties and Taxes including Import Duties (whether local to you or otherwise) is your responsibility.
Data
Protection
We
will not give out, sell or rent information about you to any other Company
or Supplier. Your details will not be used by us or forwarded by us to
any third parties for the purposes of unsolicited marketing.
We shall be entitled to vary or cancel any Contract with you, if necessary, through Act of God, war, strike, lock-outs, fire, flood, tempest, or any other cause beyond our control or if we are unable, for any reason, to obtain the Goods needed to perform our contract with you, when we shall not be responsible in any way to you for inability to deliver any Goods caused by such contingencies.
Whilst we make all reasonable attempts to exclude viruses from the website we cannot ensure such exclusion and no liability is accepted for viruses and thus you are recommended to take all appropriate safeguards before downloading information from this website.
These Terms and any claim based on the use of information from this website shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.
